Service Description
Ardent.pet is a web-based application for cat breeders that helps manage breeding records and related administration. Features may include (without limitation) litter information, weight tracking, health records, pedigree data, microchip details, and generating PDF owner packs.
Record-keeping only. The Service provides administrative and record-keeping tools. It is not a registry, kennel club service, legal service, or veterinary service, and it does not provide veterinary advice. You remain solely responsible for your animals, breeding decisions, welfare standards, health decisions, and compliance with applicable laws and regulations.
Generated PDFs. Any PDFs or documents generated by the Service are produced based on information you provide and templates we supply. You are responsible for reviewing and confirming accuracy, completeness, and suitability before sharing or relying on them.
Early Access and evolving features. The Service may be offered in “Early Access”. This means features may change, be removed, be introduced, or behave differently over time; we may also modify limits or plans. We will make reasonable efforts to communicate material changes, but you acknowledge the Service is evolving.
Account Terms
- Eligibility: You must be at least 18 years old and capable of entering into a binding contract to use the Service.
- Accurate information: You must provide accurate, current information and keep it up to date.
- Account security: You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorised access.
- Account use: Unless we agree otherwise, your account is for your individual use or your cattery/organisation and must not be shared in a way that bypasses plan limits or access controls.
Payment Terms
Some parts of the Service may require a paid subscription. Where you choose a paid plan, you agree to the following:
- Billing cycle and renewal: Subscriptions are billed in advance on a monthly or annual basis (as selected) and automatically renew at the end of each billing period unless you cancel before renewal.
- Payment processing: Payments are processed by our payment provider (currently Stripe). You authorise us (and our payment provider) to charge your selected payment method for recurring subscription fees and applicable taxes.
- Cancellation: You can cancel at any time through the Service (where available) or by contacting us. Cancellation takes effect at the end of your current paid billing period. Unless required by law, we do not provide partial refunds or credits for unused time.
- Refunds: Fees are non-refundable except where required by law. We may, at our discretion, provide refunds or credits in exceptional circumstances on a case-by-case basis.
- Failed payments: If a payment fails or is reversed, we may retry charges, suspend or limit access to paid features, and/or terminate your subscription until payment is successfully made.
- Taxes/VAT: Prices may be displayed inclusive or exclusive of VAT or other taxes depending on your location and the information you provide. You are responsible for any taxes, duties, or similar governmental charges applicable to your subscription, except for taxes on our income.
- Price changes: We may change subscription fees and plan features from time to time. If a change affects you, we will provide reasonable notice (for example by email or in-app notice) and the change will take effect on your next renewal unless stated otherwise.
Data Ownership & Usage
Your data. You retain ownership of the data and content you upload or input into the Service, including breeding records, notes, and any personal data you include in owner packs (“Customer Data”).
Our licence. You grant Ardent a non-exclusive, worldwide licence to host, store, process, copy, transmit, and display Customer Data only as necessary to provide, maintain, secure, and improve the Service, and to comply with legal obligations.
Third-party data and consents. You may upload or generate documents containing information about third parties (for example, kitten owners). You represent and warrant that you have the necessary rights, lawful basis, and consents to provide such information to us and to use it in the ways you choose (including sharing owner packs), and that your use complies with applicable data protection law.
Backups and integrity. We take reasonable steps to protect and maintain the Service, but we do not guarantee that Customer Data will never be lost, corrupted, or unavailable. You should keep your own copies of important records.
After cancellation or termination. If your subscription ends:
- We will make reasonable efforts to provide a self-service export where available. If self-service export is not available for some data, you may request an export and we will make reasonable efforts to provide it.
- We may retain your Customer Data for up to 30 days to allow reactivation and/or export.
- After that, we will delete or anonymise Customer Data within 90 days, unless we must retain it longer for legal, regulatory, tax, dispute, or security reasons.
Acceptable Use
You agree not to misuse the Service. In particular, you must not:
- Use the Service in any way that violates applicable laws or regulations.
- Use the Service in connection with cruelty, neglect, or practices that breach animal welfare laws, regulations, or applicable breeding codes in your jurisdiction.
- Upload, store, or share content that you do not have the right to use, or that infringes intellectual property, privacy, or other rights of others.
- Upload malicious code or attempt to probe, scan, or test the vulnerability of the Service, or bypass security or access controls.
- Reverse engineer, decompile, or attempt to derive source code from the Service except to the extent such restriction is prohibited by law.
- Interfere with or disrupt the Service, including by unreasonable load, automated scraping that exceeds fair use, or abusive behaviour toward our staff or other users.
We may investigate suspected misuse and take action, including removing content, limiting functionality, or suspending accounts.
Service Availability
We aim to provide a reliable service, but availability can be affected by maintenance, updates, and factors outside our control. The Service is provided on an “as is” and “as available” basis. We do not promise uninterrupted or error-free operation.
We may perform maintenance or make changes to the Service. Where practicable, we will provide advance notice of planned maintenance that may materially affect availability.
Limitation of Liability
Important: Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
To the maximum extent permitted by law, Ardent is not liable for:
- Indirect, consequential, special, or incidental losses (including loss of profits, revenue, business, goodwill, or anticipated savings).
- Losses arising from your breeding decisions, animal health outcomes, welfare outcomes, or compliance decisions. The Service is not a registry and does not provide veterinary advice.
- Errors or omissions in PDFs or outputs generated from Customer Data, or any reliance on such outputs without your verification.
Subject to the paragraph above, our total liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the total fees paid by you to Ardent for the Service in the 12 months immediately preceding the event giving rise to the claim.
Termination
By you: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
By us: We may suspend or terminate your access to the Service immediately if:
- You breach these Terms (including the Acceptable Use section).
- We reasonably believe your use poses a security, legal, or operational risk.
- Payment is overdue and remains unpaid after reasonable attempts to collect.
If we suspend or terminate your account, we will take reasonable steps to notify you and explain the reason unless doing so would increase risk, compromise security, or be unlawful. Termination may result in loss of access to the Service and your Customer Data, subject to the export and deletion provisions in these Terms.
Changes to Terms
We may update these Terms from time to time, including to reflect changes to the Service, legal requirements, or how we operate. If we make material changes, we will provide reasonable notice (for example by email to the account email address and/or an in-app notice) and state the date the updated Terms take effect.
If you continue to use the Service after updated Terms take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service and cancel your subscription.
Governing Law
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service.
